Karin Law: President Boric enacts law against workplace harassment

This new law adopts various measures related to the guidelines of the International Labour Organization’s Convention No. 190. 

President Boric enacted the Karin Law this Friday, which strengthens legislation against workplace harassment.

The Karin Law modifies several legal bodies in order to strengthen measures for the prevention, investigation and punishment of workplace harassment and violence in various areas, both in the public and municipal sectors.  

This new law establishes specific protocols and measures to guarantee safe work environments for workers.  

Among the legal bodies that the Karin Law modifies are the Labor Code, constitutional organic laws and administrative statutes.  

What does the Karin Law say against workplace harassment? 

The new Karin Law establishes a protocol for the prevention of workplace and/or sexual harassment and violence as an obligation for companies and state bodies. 

This new regulation adopts various measures related to the guidelines of the International Labour Organization’s Convention No. 190. 

It is a step forward in improving sexual harassment investigation processes, and the regulation also incorporates processes for investigating workplace harassment and violence. 

Furthermore, the modifications made by the government reinforce the role of the Labor Directorate (DT) and the General Comptroller of the Republic in the corresponding investigation procedures, with the aim of providing guarantees to complainants. 

The bill also includes regulations relating to the right of workers to have their employers implement protocols for the prevention of workplace and sexual harassment and violence, establishing measures related to the protection of the privacy and honor of all those involved in investigation procedures.
